Damages
DAMAGES
When we talk about damages, we mean the right to monetary compensation when a harmful event causes injury to your physical or mental health (minor or serious bodily injury, disability or even death). Injuries resulting from a harmful event usually also give rise to other legally recognised grounds on which you are likewise entitled to monetary compensation (absence from work, hospital treatment, etc.).
Under certain conditions, you are entitled to compensation in the following most common situations:
- Traffic accident
- Accident at work
- Accidents on public or private premises
- Animal bites
- Injuries at public events
- Injuries resulting from medical errors
Monetary compensation relates to non-pecuniary damage caused by the error or fault of another, where the grounds for this type of damage are physical and mental pain, fear, loss of reputation, etc. Monetary compensation also relates to pecuniary damage resulting from the destruction of or damage to property, loss of income due to inability to work, material costs related to medical treatment, etc.
We help you gather the necessary documentation and prepare a compensation claim, and we accompany you in the procedure with the insurance company or the person who caused the damage.
In the event of an accident, it is IMPORTANT that you contact us as SOON as possible and follow our instructions, as this helps you avoid problems that may arise from unfamiliarity with the procedure.
By acting in time and with professional support, you significantly increase your chances of being awarded fair compensation.
Payment for our services is, as a rule, linked to the payment of compensation; the details are agreed in a written contract before work begins. Where court proceedings are needed to obtain compensation, we help you find an attorney (odvetnik) specialised in compensation law and work with them in preparing the case.
Legal basis: Obligations Code (OZ), in particular Article 131 (general basis of liability for damage) and Article 179 (pecuniary compensation for non-pecuniary damage).
